Smoking Still Permitted in Casino

Recently Oneida County Executive Anthony Picente declared the Department of Health will not approve the Clean Indoor Air Law on CD Food & Beverages working out of the Turning Stone Casino.

As a New York State company, CD Food & Beverage accepted to delay to the State Liquor Authority on all orders concerning the sale of alcohol, cancel property taxes and stay by New York state legislation.

Picente explained that the country will not have the capability to approve the state’s non-smoking legislation because of lack of authority.“It is a part of the combined problem that still remains. Unfortunately I don’t have that capability by law to enforce,” he added.

The country’s position on this main problem will remain firm with its past procedure of not trying to enforce the new law.
Mr. Picente said: “It does me no good to make anti-smoking steps and do what, inspect and enforce something that I cannot? It’s no different because they have a liquor license. It doesn’t modify the game in that concern.” The only court will have to take a decision if the county has the right to approve a state law on a state group conducted on sovereign land.

Mark Emery, OIN spokesman, furnished The Dispatch with an e-mail Oneida Nation Enterprises Senior Vice President Pete Carmen sent to the SLA on April 29th. He wrote: “The Oneida Nation has approved the ordinances that gained the state’s measures governing health and security, like smoking at Turning Stone. This is compatible with the Section 12 of the Gaming Compact between the state and the Nation, which affords that Nation legislations and regulations controlling health and safety measures applicable to gaming opportunities shall be no less severe in meeting the goals of health and safety than standards, codes and legislations of the state referencing to public freedom.”

Referring to the health ministry, it has promised to modifying establishments in Oneida County, and also Turning Stone’s smoking policy was modified after those admissible exceptions.

“The nation has accepted a legislation that banned smoking at Turning Stone exclude in regions where waivers have been considered appropriate for similar establishments in Oneida County. The Nation’s legislations and exceptions are compatible with the Clean Indoor Air and, more relevantly, with Oneida County’s exercise of its authority to outlet waivers under the new Act.”
